FC Rides – Terms and Conditions of Use

1. The Services

FC Rides provides a platform that enables customers to arrange and schedule pre-arranged chauffeured transportation services with third-party transportation providers, including independent chauffeurs and transportation companies ("Third-Party Providers"). FC Rides does not itself provide transportation services and does not act as a motor carrier, taxi service, or rideshare network company.

Unless we agree otherwise in writing, the Services are made available for your personal or internal business use.

2. Eligibility

You must be at least 18 years old and legally capable of entering into this Agreement. By using the Services, you represent and warrant that you meet these requirements.

3. Accounts and Communications

3.1 Accounts

Certain features may require you to create an account. You agree to provide accurate information and to keep it up to date. You are responsible for activity under your account and for maintaining the confidentiality of any login credentials.

3.2 Email and SMS

You consent to receive operational messages from FC Rides (e.g., booking confirmations, ride updates, receipts) by email, phone call, and/or text message, using the contact information you provide. You may opt out of certain non-essential communications where applicable; however, opting out of operational messages may impact your ability to use the Services.

4. Reservations and Bookings

4.1 Pre-Arranged Only

All services must be booked in advance through FC Rides' approved channels. No street hails or on-demand pickups are offered through the Services.

4.2 Accuracy of Booking Details

You are responsible for providing accurate pickup/drop-off information, flight details (if applicable), passenger count, luggage details, and special requests (including child seats). Additional charges and/or service limitations may apply if booking details are inaccurate or incomplete.

4.3 Changes

Changes to reservations (including pickup time, location, additional stops, or vehicle class) are subject to availability and may result in additional charges.

5. Pricing, Fees, and Payment

5.3 Gratuity

If gratuity is included or added by default, it will be disclosed during booking or on the receipt. Where gratuity is not included, you may choose to tip your chauffeur separately.

5.4 Taxes

Charges may include applicable taxes where required by law.

5.5 Non-Refundable Charges

Charges are generally non-refundable except as required by law or as expressly stated in a written policy disclosed at booking.

6. Cancellations and No-Shows

6.1 Cancellation Policy

Cancellation terms vary by service type, vehicle class, location, and event date. The applicable cancellation window and fees (if any) will be disclosed during booking and/or in your booking confirmation.

6.2 No-Shows

A "no-show" may be charged up to 100% of the booking amount. A no-show may include (without limitation):

• Failure to appear at the designated pickup time and location
• Failure to respond to communication attempts within the designated wait time
• Cancellation after the chauffeur has arrived

6.3 Force Majeure

FC Rides is not responsible for service delays or failures caused by events beyond reasonable control, including severe weather, natural disasters, road closures, accidents, government actions, strikes, civil disturbances, or network outages.

7. Wait Time, Stops, and Service Rules

Wait time allowances (including airport pickup grace periods) vary by service type and location and will be disclosed at booking or in your confirmation. Additional wait time, stops, or route deviations may incur additional charges.

8. Passenger Responsibilities and Vehicle Condition

8.1 Conduct

Passengers must behave respectfully and lawfully. We may refuse or terminate service if passenger behavior creates a safety risk, violates law, or threatens damage to the vehicle.

8.2 Smoking, Food, and Alcohol

Smoking, vaping, and consuming food or alcohol in the vehicle may be prohibited. Violations may result in cleaning fees and/or service termination.

8.3 Vehicle Damage

You agree to reimburse FC Rides or the Third-Party Provider for any damage to the vehicle caused by you or your passengers (including excessive cleaning).

9. Lost Property

FC Rides is not responsible for items left in vehicles. We will attempt reasonable efforts to facilitate return of lost items, but recovery is not guaranteed.

10. Third-Party Providers

Transportation services are provided by independent Third-Party Providers, not by FC Rides. FC Rides is not responsible for the acts, omissions, or conduct of any Third-Party Provider.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, FC RIDES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

FC Rides does not warrant that the Services will be uninterrupted, error-free, or secure, or that any defect will be corrected.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FC RIDES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

13. Indemnification

You agree to indemnify and hold harmless FC Rides, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

14. Disputes and Arbitration

Any disputes arising from or related to these Terms or the Services will be resolved through binding arbitration in accordance with applicable arbitration rules. You agree to waive any right to a jury trial or to participate in a class action.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

16. Modifications

We may modify these Terms at any time. Changes will be effective when posted. Your continued use of the Services constitutes acceptance of the modified Terms.

17. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.

18. Entire Agreement

These Terms, together with any supplemental terms, constitute the entire agreement between you and FC Rides regarding the Services.

19. Assignment

You may not assign these Terms without FC Rides' prior written consent. FC Rides may assign these Terms without restriction.
